The following data includes brief descriptions of sexual misconduct followed by disciplinary action issued to the guilty party. Outcomes are grouped by year and sorted by month.

2024

June 2024 – July 2024

Abusive Sexual Contact, Article 120 – An Airman in the Air National Guard on Title 10 Orders assigned to the 81st Training Group used a drill team rifle to poke a fellow Airman without their consent. The Airman also engaged in sexual harassment consisting of unwanted sexual comments. The Airman received a counseling from their commander.

April 2024 – May 2024

Nonjudicial Punishment

Abusive Sexual Contact, Article 120, UCMJ – An Airman touched the breasts of a fellow Airman and kissed the Airman on the neck without consent. In addition, the Airman unlawfully grabbed a fellow Airman’s hand without consent, in violation of Article 128 of the UCMJ. The Airman received nonjudicial punishment consisting of reduction to the grade of Airman Basic, forfeiture of $455.00, and a reprimand. Finally, the Airman was discharged from the Air Force with an Under Honorable Conditions (General) service characterization.

Administrative Action

Sexual Assault, Article 120, UCMJ – An Airman First Class in the Air National Guard on Title 10 orders committed a penetrative sexual act and touched the breast and neck of another Airman. The Airman First Class received a Letter of Admonishment through the Air National Guard chain of command.

February 2024 – March 2024

Nonjudicial Punishment

Sexual Assault, Article 120, UCMJ - An Airman sexually assaulted two Airmen in separate incidents by committing penetrative sexual acts without their consent. In addition, the Airman inappropriately touched another Airman without the member’s consent. The Airman received nonjudicial punishment consisting of a reduction to the grade of Airman Basic, forfeiture of $1,008.00 pay, and a reprimand.

Administrative Actions

Indecent Viewing, Visual Recording, or Broadcasting, Article 120c – A First Lieutenant photographed and video recorded the private areas of a civilian, without their consent and under circumstances in which they had a reasonable expectation of privacy. In addition, the First Lieutenant sent a sexually explicit video of an individual without their consent to another individual. The First Lieutenant received a reprimand.

Assault Consummated by Battery, Article 128 – An Airman Basic tickled and touched the upper thigh of a fellow Airman on multiple occasions without their consent. The Airman Basic received a reprimand.
2023
December 2023 – January 2024

Administrative Discharge

Under Honorable Conditions (General) Discharge, Misconduct – An Airman First Class touched the buttocks and breasts of another Airman without their consent. The Airman First Class accepted an Article 15 and received punishment consisting of a reduction to the grade of Airman and a reprimand. The member subsequently received an under honorable conditions (General) discharge.

Under Honorable Conditions (General) Discharge, Misconduct – A Second Lieutenant committed conduct unbecoming an officer and indecent conduct by sending unsolicited images of genitalia to other individuals. The Second Lieutenant accepted an Article 15 and received punishment of forfeitures of $1,893 per month for two months and a reprimand. The member subsequently received an under honorable conditions (General) discharge.

Administrative Action

Sexual Harassment, 10 U.S.C. § 1561(e)(3) – An Airman First Class sexually harassed a fellow Airman by making repeated comments of a sexual nature verbally and via text message. The Airman First Class received a reprimand.

October - November 2023

Results of Courts-Martial

Sexual Assault, Article 120, UCMJ - A First Lieutenant was acquitted at a General Court-Martial of committing sexual assault against a military member and a civilian without their consent.

Sexual Assault, Article 120, UCMJ; Domestic Violence, Article 128b, UCMJ – A Staff Sergeant was found not guilty at a General Court-Martial of committing a sexual assault upon his spouse without her consent. The Staff Sergeant was convicted of multiple acts of domestic violence against his spouse. The Staff Sergeant was sentenced to four (4) months of confinement, reduction to the grade of E-2, forfeiture of $500.00 pay per month for four months, and a reprimand.

Dereliction of Duty, Article 92, UCMJ – A Captain at a General Court-Martial pled guilty at a General Court-Martial to dereliction of duty for engaging in inappropriate and unprofessional conduct with an enlisted member that detracted from the superior-to-subordinate authority. The Military Judge sentenced the Captain to seven (7) days of confinement, forfeiture of $3,945.00 pay, and a reprimand.

Dereliction of Duty, Article 92, UCMJ – A Master Sergeant pled guilty at a General Court-Martial to dereliction of duty for making sexual comments about a junior enlisted airman. The Military Judge sentenced the Master Sergeant to four (4) days of confinement, reduction to the grade of E-6, and a reprimand.

Administrative Discharge

Under Other Than Honorable Conditions (UOTHC) Discharge, Misconduct – An Airman Basic sexually assaulted his spouse by committing a sexual assault without her consent. The Airman Basic received a Letter of Reprimand and a UOTHC discharge.

Administrative Action

Counseling, Sexual Harassment, 10 U.S.C. § 1561(e)(3) – A Commander Directed Investigation (CDI) found that a male Airman sexually harassed a female Airman by making repeated verbal comments of a sexual nature. The Airman received a Counseling.
